Terms of Service & Privacy Policy

Last Updated: 26 October 2026

Welcome to Martekio! These terms are the rules for using our service. By using Martekio, you agree to these terms.

1. Our Service

Martekio provides a Software-as-a-Service (SaaS) platform that helps brands, and the agencies that represent them, monitor and understand their Share of Voice in AI assistants.

AI Content Disclaimer: The Service retrieves data from third-party AI assistants and search surfaces, currently ChatGPT (OpenAI), Claude (Anthropic), Gemini (Google), Perplexity, Grok (xAI), Google AI Overviews, Google AI Mode and Microsoft Copilot. Some of these are reached through third-party data providers rather than directly. Martekio does not guarantee the accuracy, completeness, or consistency of the content generated by these third-party engines, as their outputs are determined by external algorithms beyond our control. The set of assistants we cover may change as providers launch, alter, or withdraw their services.

2. Your Account

To use Martekio, you must create an account. You are responsible for keeping your account password safe. Sharing login credentials with third parties is strictly prohibited. You are responsible for all activities that happen under your account.

3. Subscriptions & Payment

Our service is billed on a subscription basis in advance on a recurring, periodic basis (e.g., annually).

Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account settings or by contacting us before the renewal date.

Payments are non-refundable. If you fail to pay your subscription fee, we may suspend or terminate your access to the Service.

If you cancel your subscription before the end of the billing cycle, either in writing or in-app, no refund will be due.

4. Your Data

You own all the data, information, or material you submit to the Service (“Your Data”).

You grant us a license to use, copy, and process Your Data solely for the purpose of providing and improving the Martekio service for you.

We will handle your personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). How long we keep it is set out in section 6 of the Privacy Policy below.

5. Acceptable Use & Reselling

You agree not to misuse the Service. Specifically, you must not:

  • Resell, sublicense, or commercially exploit Martekio reports or data without express written permission.

  • Use the Service for any illegal purpose.

  • Try to reverse-engineer or disrupt our Service or its underlying infrastructure.

  • Upload any malicious software or bypass security measures.

6. Intellectual Property

We own all rights, title, and interest in and to the Martekio platform, software, and brand. You receive a limited, non-exclusive license to use the Service as permitted under these Terms.

7. Termination & Cancellation

You can cancel your subscription at any time via your Account Settings or by emailing us at contact@martekio.com. Your cancellation will become effective at the end of your current billing period. No refunds will be issued for payments already made, including for partial subscription periods.

We may terminate or suspend your account immediately, without notice, if you breach these Terms or fail to provide payment.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available.” Martekio makes no warranties of any kind, express or implied, regarding the uptime, results, or accuracy of the insights provided.

9. Limitation of Liability

To the maximum extent permitted by law, Martekio shall not be liable for any indirect, incidental, or consequential damages, including lost profits or service interruptions. Our total liability is limited to the amount you paid us in the last six (6) months.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes will be handled exclusively in the courts of Paris, France.

11. Contact Us

If you have any questions about these Terms, contact us at contact@martekio.com.

Privacy Policy for Martekio

Martekio is committed to protecting your privacy. This policy explains what personal data we collect and how we use it.

1. Who We Are

Martekio, a SASU registered with the Paris Trade and Companies Register under number 999 437 791, with its registered office at 60 rue François 1er, 75008 Paris, France, is the “data controller” for the personal data described in this policy. This covers visitors to our website and the people who use the Martekio platform.

If you have any questions about this policy or your data, contact us at contact@martekio.com.

2. What Information We Collect and Why

Account Information:
We collect your name, company name, and email address to create and manage your account.

Payment Information:
Billing details are collected to process subscriptions. We do not store full credit card details; these are handled securely by our processor (Stripe).

Usage Data:
Technical information (IP address, browser type) and how you use the app, including session recordings, are collected to improve our Service and ensure security.

Contact Form:
When you write to us through the form on our website, we collect your name, email address, and message so we can reply to you.

Website Analytics:
If you accept analytics cookies, Google Analytics collects information about how you use our website, such as the pages you visit, your device and browser, and your approximate location. We use it to understand and improve the website.

3. Why We Are Allowed to Use Your Data

We only process your personal data when the GDPR gives us a legal basis to do so:

  • Contract: to create your account, provide the Service, and handle billing.

  • Legal obligation: to keep invoices and accounting records required by French law.

  • Legitimate interests: to keep the Service secure, prevent fraud, reply to your inquiries, improve our product, and tell customers about product updates.

  • Consent: for analytics cookies on our website and for marketing emails to people who are not customers. You can withdraw your consent at any time.

4. Who We Share Your Data With

We do not sell your personal data. We share information only with trusted processors required to run the service:

  • Payment Processors (Stripe)

  • Cloud Hosting (Google Cloud)

  • Product Analytics and Session Recording (Mixpanel, PostHog)

  • Website Hosting and Contact Form (Framer)

  • Website Analytics (Google Analytics)

  • Search Data (Google Search Console, only if you connect it)

We may also disclose personal data if the law, a court order, or a public authority requires it, or if Martekio is merged with or acquired by another company. In that case, your data would remain protected by this policy.

5. International Data Transfers

The Martekio platform and its data are hosted on Google Cloud in the European Union. Some of our providers, such as Stripe, Google Analytics and Google Search Console, may process data outside the European Economic Area (EEA). These transfers are protected by Standard Contractual Clauses (SCCs) approved by the European Commission or, for US providers certified under it, the EU-US Data Privacy Framework.

To measure how AI assistants describe your brand, we send your tracked prompts to AI providers (such as OpenAI, Anthropic, Google, Microsoft, Perplexity and xAI), directly or through specialist data providers. Some of these process the prompts outside the EU. The prompts cover brands, products and topics and contain no personal data.

6. How Long We Keep Your Data

Analysis data, the AI responses, citations, and the metrics derived from them, is retained for 365 days by default. Your plan may set a different period, and we can agree a shorter one with you on request.

Once data passes that retention period it is archived: it stops appearing in Insights, reports, exports and the API, and is no longer used to calculate your metrics. Internal Log Data is deleted outright rather than archived.

Account information is kept for as long as your account is open. When an account is closed we erase the personal data we hold for it on request, other than records we are required to keep for legal, tax or fraud-prevention purposes.

Accounts with no login and no active subscription for three (3) years are deleted, along with the personal data they hold.

Messages sent through our contact form are kept for up to three (3) years after our last contact with you.

Invoices and accounting records are kept for the period required by French law, currently ten (10) years.

Analytics cookies are kept for no more than thirteen (13) months.

7. Emails We Send

We send service emails that are needed to run your account, such as account notices, billing receipts, and security alerts.

We may also send customers occasional product updates. Every such email includes an unsubscribe link. We only send marketing emails to people who are not customers if they have agreed to receive them.

8. Cookies

Our website uses a small number of cookies:

  • Necessary cookies: these make the website work and remember your cookie choices. They do not require your consent.

  • Analytics cookies: Google Analytics cookies, which help us understand how visitors use the website. They are only set if you accept them in our cookie banner.

You can change your choice at any time through the cookie banner or your browser settings. To learn more about cookies, visit www.cnil.fr.

9. How We Protect Your Data

We use technical and organizational measures to protect your personal data against loss and unauthorized access, use, or disclosure. Data is encrypted in transit, and access to personal data is limited to the people who need it to run the Service. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Your Rights (GDPR)

Under the GDPR and the French Data Protection Act, you have the right to:

  • Access your personal data and receive a copy of it.

  • Rectify data that is inaccurate or incomplete.

  • Erase your data when it is no longer needed or you withdraw your consent.

  • Restrict how we process your data in certain cases.

  • Receive your data in a portable, machine-readable format.

  • Object to our processing of your data, and to direct marketing at any time.

  • Withdraw your consent at any time, where processing is based on consent.

  • Give instructions on what happens to your data after your death.

To exercise these rights, contact us at contact@martekio.com. We will reply within one month. You may also lodge a complaint with the CNIL (France).

11. Third-Party Websites

Our website may link to other websites. We are not responsible for how those websites collect or use personal data, and we encourage you to read their privacy policies.

12. Changes to This Policy

We may update this policy from time to time. The “Last Updated” date at the top of this page shows when it last changed. If we make significant changes, we will notify customers by email.
